The Red Room Sessions were recorded in 2012. It's release was delayed due to a long ensued legal battle between the Emu Tonic members and their management over royalties for their critically acclaimed debut album Apples & Deutschland. After eighteen months of unsuccessful arbitration between the parties involved the matter was brought to court. A six month court battle ensued. In light of discovering that the very existence of Emu Tonic's management was questionable and that the album had not incurred any royalties to date, the judge ruled that the band members retain all rights concerning their own music. The band celebrated their victory by releasing a back-log of recording sessions, including The Red Room Sessions.
When asked why the band sought justice in the courts, Mr Fafufu, one of the founding members of the group stated:
"No one knows how these things begin. It's like a snake eating its own tail. We had convinced ourselves that we were in a court battle but in actual fact we were all strung out on insect repellent in a friends garage for two years. And apparently there is no precedent for that in Irish copyright law.".
He finished his statement by stating that "the real victors are the listeners out there (Mr Fafufu gestures to outside the garage; inhales deeply from a petrol container and continues), without whom we would still exist but there would be no one to hear us."
